Client Query 104:- Hi, Wanted to ask that in order to meet ongoing operational requirements of existing Electrical/IT setups maintenance, can a procuring agency award a contract on “Indefinite Delivery & Indefinite Quantity” basis (IDIQ). Where goods will be order on need basis on a fix price as and when required and Supplier will be selected through open competitive bidding procedure for a period of three years.

As per your query, the answer to it is this that a procuring agency can not award a contract on “Indefinite Delivery & Indefinite Quantity” basis (IDIQ) to any supplier or contractor. Procurement procedures and the relevant requirements outlined in Public Procurement Rules, 2004 and the relevant regulations made thereunder shall be followed in each procurement with the public funds.
