Client Query 171:- Hi, wanted to discuss a scenario with you. Initially supply order for 126 items was awarded. Now the department wants to revise this initially awarded supply order by awarding only 66 items. Out of these 66 items, the department also wants to change the manufacturer for 12 items going 15% above from the original contract cost and at the meanwhile the department demands us to provide these 12 items while changing the quoted manufacturer(i.e going beyond the manufacturers mentioned by our firm in original tender. Your guidance requested whether PPRA provides any rule/clause to change the manufacturer going beyond the scope of original contract?

Answer:- Thank you very much for writing to us. As per your query a bidder is required to supply those goods, which were approved under the evaluation criteria already provided bidding documents of a department. Provision of goods, which were neither evaluated as per evaluation criteria nor provided in the bidding documents, is a violation of Public Procurement Rules, 2004.
