Lawyer signing legal documents

Client Query 093:- Hi, Hope everything is fine at your end. Now wanted to ask that if a bid security is less for example less than the bid price then shall the bid rejected be deposited by the bidder to continue the process if he is the lowest evaluated bidder? If this provision is present in bidding documents then can the bidder deposit the deficit at the time of opening of bids?

Raja Jamil, UK

Answer:- Thank you for writing to us. As per your query, a procuring agency is required to evaluate the bid in accordance with the standard terms and conditions provided in the bidding documents. If a bidder submits less bid security as prescribed in the bidding documents then his bid is liable to be rejected. However, a relevant provision as mentioned above already exists in the bidding documents that the deficit, if any, in the bid security shall be deposited by the bidder then his bid can be considered. Hope this answers your query!
