PAKISTAN WAPDA DEVELOPMENT AUTHORITY (CHAIRMAN AND MEMBERS) (Salary, Allowance and Conditions of Service) Rules, 1980

 

S.R.O. 391 (I)/80, dated 14.4.80 (Gaz. P.I. Extra., 13.4.80).— In exercise of the powers conferred by section 5 of the Pakistan Water and Power Development Authority Act, 1958 (West Pakistan Act No. XXXI of 1958), the Federal Government is pleased to make the following Rules namely:–

 

1.         Short title and commencement.—(1) These Rules may be called the Pakistan Water and Power Development Authority (Chairman and Members) (Salary, Allowance and Conditions of Service) Rules, 1980;

(2)        They shall come into force at once

2.         Definitions.— Unless there is anything repugnant in the subject or context:–

(a)        “Act” means the Pakistan Water and Power Development Authority Act, 1958 (West Pakistan Act No. XXXI of 1958);

(b)        “Management Grades” means the Management Grades prescribed vide Establishment Division, Government of Pakistan Office Memorandum No.18.2.78-C.V., dated the 13th July, 1978;

(c)        “N.P.S.” means the National Pay Scales, including allowances fringe benefits, prescribed vide Finance Division, Government of Pakistan Office Memorandum No. F.1(39)/Gaz. Imp. 1/73, dated 18th August, 1973; and

(d)        Words and expressions used but not defined in these Rules shall have the same meanings as are respectively assigned to them in the Act. Fundamental Rules or Supplementary Rules, Civil Services Regulations or the General Financial Rules.

 

3.         Method of filing the posts of Chairman and Members, their pay, allowances, etc..— (1) The post of Chairman shall be filled from amongst the persons belonging to the following categories, namely:–

(a)        a non-official, having such experience and qualifications as the Federal Government may determine;

(b)        an employee of a Corporation, provided he is holding a post in NPS-21 or equivalent to M-III.

(c)        an employee of WAPDA, if he is already a Member in WAPDA;

(d)             a serving civil officer in Grade-22;

(e)             a serving military officer of the rank of Major General or above;

(f)              a retired civil officer of NPS-22; or

(g)             a retired military officer of the rank of Major General or above—

(2)        The Chairman if he is a person belonging to–

(a)             category (a) or (b) of sub-rule (1), shall draw pay in M-II;

(b)             category (c) or (d) of sub-rule (1) shall draw pay in NPS-22; and

(c)             category (e), (f) or (g) of sub-rule (1) shall draw in accordance with the orders issued by the Federal Government from time to time for the fixation of pay of retired Government Servants (including retired military officers) re-employed ni autonomous Organisations.

(3)        The Chairman will be entitled to the allowances and perquisites and admissible to an officer in M-II.

(4)        The post of Member shall be filled from amongst the persons belonging to the following categories, namely:–

(a)        a non-official, having such experience and qualifications as the Federal Government may determine;

(b)        an employee of Corporation, provided he is holding a post equivalent to M-IV;

(c)        an employee of WAPDA if he is already a General Manager in WAPDA;

(d)        serving civil officer in NPS-21;

(e)        a serving military officer of the rank of Major General.

(f)         a retired civil officer of NPS-21; or

(g)        a retired military officer of the rank of Major General.

(5)        A Member, if he is person belonging to:–

(a)        category (a) or (b) of sub-rule (1), shall drawn pay in M-III;

(b)        category (c) or (d) of sub-rule (1) shall draw pay in NPS-21; and

(c)        category (e), (f) or (g) of sub-rule (1) shall draw pay in accordance with the orders issued by the Federal Government from time to time for the fixation of pay of retired Government Servants (including retired military officers re-employed in Autonomous Organizations).

(6)        Members shall be entitled to the allowances and perquisites as admissible in M-III.

4.         Leave.— (1) In the case of non-officials or retired civil or military officers appointed as Chairman or Members, leave shall be admissible as prescribed under the scheme of Management Grades from time to time and the serving civil servants or officers of the Authority drawing pay in NPS shall on appointment as Chairman or Members continue to be governed by the leave Rules applicable to them in their service before such appointment.

(2)        Leave, other than casual leave shall be sanctioned by the Federal Government to the Chairman and Members.

(3)        Casual leave to the Chairman shall be sanctioned by the Federal Government and to the Members by the Chairman.

 

5.         Provident fund, gratuity, pension, etc.— The non-officials, other than the retired civil or military officers appointed as Chairman and Members, shall for the purposes of provident fund, gratuity and pension, be governed by the scheme of Management Grades and the serving civil servants and the officers of the Authority drawing pay in NPS shall be governed by the Ruels applicable to them in their parent Departments.

6.         Medical attendance.— The non-officials appointed as Chairman, Members and retired civil or military officers shall be entitled to medical facilities provided for in the scheme of Management Grades and the servants and the officers of the authority drawing pay in NPS shall be governed by the Medical Attendance Rules applicable to them in their parent departments or in the Authority, whichever, may be more advantageous to them.

7.         Supplementary.— In all matters not provided for in these Rules, the Chairman and the Members shall be governed by the Rules applicable to the officer of their status under the Federal Government or as the Federal Government may determine.

8.         Repeal.—The West Pakistan Water and Power Development Authority (Chairman and Members) Service Rules, 1972 are hereby repealed.

THE EMPLOYEES OF PAKISTAN WAPDA (ALLOCATIONI TO PROVINCES) ORDER, 1979

 

[PRESIDENT’S ORDER No. 240 OF 1979]

In exercise of the powers conferred by clause (1) of Article 20 of the Province of West Pakistan (Dissolution) Order, 1970 (P.O. No.1 of 1970) and of all other powers enabling him in that behalf, the President is pleased to make the following Order:

 

1.         Short title and commencement.—(1) This Order may be called the Employees of the Pakistan Water and Power Development Authority, (Allocation to Provinces) Order, 1979.

(2)        It shall come into force at once

2.         Allocation of Employees of Pakistan Water and Power Development Authority to Provinces.— All persons serving in connection with the affairs of the Government of West Pakistan in the Electricity and Irrigation Departments, who were require to serve under the Pakistan Water and Power Development Authority under sub-section (1) of section 17, of the Pakistan Water and Power Development Authority Act, 1958 (West Pakistan At XXXI of 1958) are allocated to the Provinces where they were serving at the time of the creation of the Province of West Pakistan or if they were appointed by the Government of West Pakistan after the creation of that Province to the Provinces of their permanent resident.
