MINING BOARD RULES, 1951 (AMDT.)

(Pakistan Gazette, 17th February, 1976)}

S.R.O. 156(1)/76.— In exercise of the powers conferred by clause (a) of section 30 of the Mines Act, 1923 (IV of 1923), the Federal Government is pleased to direct that the following amendments shall be made in the Mining Board Rules, 1951 (See PLD 1951 Statutes 504) the same having been previously published, as required by sub-section (1) of section 31 of the said Act, namely:–

In the aforesaid Rules,—

(1)        In Rule 2, in clause (b), for the words and figures “to be constituted under rule 3” the words and figure “constituted under section 10” shall be substituted;

(2)        Rule 3 shall be omitted;

(3)        in Rule 7, in clause (b),—

(i)         in sub-clause (ii), for the full-stop at the end a colon shall be substituted and thereafter the following proviso shall be inserted, namely:–

“Provided that if no nomination is received by the date fixed therefore, the Federal Government may nominate such persons on the Board as it may deem competent to represent the interest of owners of mines or their representatives,”; and

(ii)         in sub-clause (iv), for the full-stop at the end a colon shall substituted and thereafter the following proviso shall be added, namely:–

“Provided that if no voting papers re received by the date fixed therefore, the Federal Government may nominate such persons on the Board at it may deem competent to represent the interest of owners of mines or their representatives”;

(4)        in Rule 1, in clause (b), for the full-stop at the end a colon shall be substituted and thereafter the following proviso shall be added, namely:—

“Provided that if no recommendation is received from the trade unions by the date fixed therefore, the Federal Government may nominate such persons on the Board as it may deem competent to represent the interest of the miners”;

(5)        in Rule 9, for the full-stop at the end a colon shall be substituted and thereafter the following proviso shall be added, namely:–

(6)        for rule 12, the following shall be substituted, namely:–

“12. The non-official members, when they attend a meeting of the Board, shall be entitled to traveling and daily allowances as admissible to a Government servant drawing a pay of Rs.15,000 per month,”;

(7)        after rule 13, the following new rule shall be inserted, namely—

“13A The Chairman shall preside at every meeting of the Board at which he is present.

(2)        If the Chairman is absent from any meeting, the members present shall elect by majority of votes, one of their members to preside over the meeting and the member so elected shall at that meeting exercise all the powers of the Chairman” and

(8)        in Rule 16, for the full-stop at the end a colon shall be substituted and thereafter the following proviso shall be added namely:—

“Provided that if any meeting the quorum is not present, the Chairman may adjourn the meeting to a date not less than fourteen days after the date of that meeting informing the member present and notifying other members that the purpose to dispose of the business of the adjourned meeting irrespective of there being a quorum, and it shall thereupon be lawful to dispose of business at such meeting irrespective of the number of member of members attending”.
