STANDING POWER RATES ADVISORY BOARD ORDER, 1972 (PRESIDENT’S ORDER 18 OF 1972) [Gazette of Pakistan, Extraordinary, 21st April, 1972] No. 24 (1)/72-Pub.–

The following Order made by the President on the 20th April, 1972, is hereby published for general information.

Whereas section 35 of the Electricity Act, 1910 (XI of 1910) provides that the Provincial Government may, for the whole or any part of the Province, constitute an Advisory Board;  And whereas it is expedient to provide for an Advisory Board common to the Provinces of Balochistan, the North-West Frontier, the Punjab and Sindh and the Centrally Administrated Areas;  Now, therefore, in pursuance of the Proclamation of the 25th day of March, 1969, read with the Proclamation of the 20th day of December, 1971, and the Provincial Government Order, and the exercise of all powers enabling him in that behalf, the President is pleased to make the following Order:–   1. Short title, extent and commencement. —  (1) This Order may be called the Standing Power Rates Advisory Board Order, 1972.   (2) It extends to the whole of Pakistan except the Province of East Pakistan.   2. Constitution of the Advisory Board. —  (1) The Central Government shall constitute a Standing Power Rates Advisory Board, hereinafter referred to as the Board, consisting of the following members, namely:–  (a) the Chief Engineering Advisor, Natural Resources Division, Government of Pakistan, who shall also be the Chairman of the Board;  (b) seven persons elected as members of the National Assembly of Pakistan to be nominated by the President, of whom one each shall be from Balochistan and the North-West Frontier Province, three from the Punjab and two from Sindh;  (c) one representative each to be nominated by the Central Government to represent—  (i) the Ministry of Finance, Government of Pakistan; and  (ii) the Planning Commission Government of Pakistan;  (iii) one representative each to be nominated by the Government of Balochistan, North-West Frontier Province, the Punjab and Sindh to represent each Provincial Government.  (iv) One representative to be nominated by the West Pakistan Water and Power Development Authority to represent that Authority; and  (v) One representative to be nominated by the Central Government to represent the office of the Chief Engineering Advisor, Natural Resources Division, Government of Pakistan, who shall also be the Secretary of the Board.  (2) The Board shall be deemed to be an Advisory Board constituted under section 35 of the Electricity Act, 1910 (IX of 1910), for each of the Provinces of Balochistan, the North-West Frontier, the Punjab and Sindh and for the Centrally Administered Areas; and the Provisions of the Act in so far as they relate to the Advisory Board shall have effect accordingly.   3. Functions of the Board.—  The functions of the Board shall been to advise on the power rates and tariff structures and costs of various electric supply undertakings within the areas to which this Order extends and to perform such other functions as the Central Government may, from time to time, direct.   4. Procedure, etc. of the Board. —  The Central Government may, by general or special order:–  (a) regulate the procedure of the Board;  (b) determine the term of office of the members of the Board; and  (c) give directions as to the payment of fees to, and traveling expense4s incurred by, any member of the Board, not being a Government servant, for the performance of his duties.
