Khula (delegated divorce) is a release from matrimonial bond which is a woman’s right, according to dictates of  the Holy Qur’an.Such a right can be exercised if circumstances indicate that it was impossible for the parties to live within limits prescribed by God and the continuance of their marriage would give birth to hateful union.

Under the law, Pakistani Courts are bound to grant right of Khula’ to a woman even if she expressly claims or omits to claim dissolution on ground of Khula’ in her pleadings and even if other grounds for seeking dissolution of marriage cannot be proved. 1998 C L C 1929 1993 MLD 1507; 1994 CLC 230 and 1995 CLC 657 ref.
