Ijaz Ahmad and Ghulam Rabbani Judgment Result: Order accordingly Other Law Journal References: PLD 2010 SC 731 constitution of Pakistan, 1973– —-art. 184(3)–human right case was initiated on news item–treated as petition u/art. 184(3) of constitution–action regarding huge loss to public exchequer by ignoring bid fauji foundation and multinational energy from vital by awarding lng contract–massive corruption in awarding contract of supply of lng–huge loss had been caused to public exchequer–before awarding the contract to the foreign firm, ministry of Petroleum had decided to give contract to shell gas & power co–recommending the name which was interested in short term lng–due to intervention of ministry of Petroleum declined to approve the name of shell gas & power for supply of lng and recommended the name of gdf suez–proceedings for completion of the contract were not carried on in transparent manner–validity–ministry of Petroleum and ssgcl had not followed the process for awarding contract for lng supply for mashal or short term project seriously–held: it was duty of the court to ensure that public procurement regulatory authority ordinance, 2002 r/w public procurement rules, 2004 are adhered to strictly to exhibit transparency–it is universally recognized principle that such type of transactions must be made in transparent manner for satisfaction of the people who are virtual owners of the national exchequer, which is being invested in these projects–petition was disposed of.
