S.17(2) read with Section 99 as amended in 1981 by U.K.–First class engineer–Certificate of–Issuance of–Prayer for–Refusal of–Challenge to–Whether amendment in section 99 in 1981 by U.K. prevents Government of Pakistan from issuing a certificate of service to personnel in Pakistan Navy–Question of–From 14th of August, 1947, Merchant Shipping Act of 1894 and that of 1923, both continued to be applied to Pakistan–Held: Amendments including amendment made in 1981 deleting section 99 by U.K. are not applicable in Pakistan–Held further: Section 17 of Act is an existing and binding provision of law–Petition accepted. S.17(2)–First class engineer–Certificate of–Issuance of–Prayer for–Refusal of–Challenge to–Section 17(2) applies to persons who have attained rank of Engineer or Assistant Engineer and apply for grant of certificate. of service as first class engineer or second class engineer without examination–Held: Contention that certificate cannot be issued to petitioner as earlier no such certificate had been issued to any officer of Pakistan Navy, does not seem to be tenable and cannot serve as a precedent to refuse exercise of jurisdiction under section 17(2) of Act which is clear, unambiguous and does not warrant any exception.
