PUNJAB LOCAL GOVERNMENT
ELECTION RULES, 2000

[Gazette of Punjab, Extraordinary, 19th October 2000]
No. SOV (LG) 5-9/2000 dated 19-10-2000.
In exercise of the powers conferred upon him under section 38 of the Punjab Local Government Elections Ordinance, 2000, Governor of the Punjab is pleased to make the following rules, namely.

CHAPTER-1
PRELIMINARY
1. Short title and commencement:

1) These rules may be called the Punjab Local Government Elections Rules, 2000.

2) They shall come into force at once and shall apply, notwithstanding anything to the contrary contained in any other rules on the subject.

2. Definitions: In these rules unless there is any thing repugnant in the subject or context;

i) “Appellate Authority” means an appellate authority appointed under these rules;

ii) “ballot paper” means a ballot paper given in Forms X(A), X (B), X(C) or \x (D) in the rules;

iii) “ballot paper account” means a ballot paper account prepared under these rules;

iv) “candidate” means a person nominated for election as member;

v) “contesting candidate” means a candidate who has been validly nominated for election as a member of ward or as a Nazim or a Naib Nazim of a district, Tehsil, Town or Union, and has not withdrawn his nomination on or before the withdrawal day;

vi) “Council” means a Zila Council, a Tehsil Council or a Town Council and a Union Council constituted under the Ordinance.

vii) “Delimitation Officer” means a person appointed for delimitation of a ward of a Union Council and includes an Assistant Delimitation Officer performing the functions of delimitation officer;

viii) “election roll” means electoral rolls prepared under section 18 of the Ordinance;

ix) “election petition” means a petition under the Ordinance or these rules calling an election in question;

x) “election tribunal” means an election tribunal appointed under the Ordinance or these rules for the trial of an election petition;

xi) “form” means a form appended to these rules;

xii) “material irregularity” means non compliance of the provisions of these rules which martially affect the result of an election;

xiii) “minority community” includes persons belonging to the Christian, Hindu, Sikh, Buddhist and Lahori Group (who call themselves ‘Ahmadis’ or by any other name)or a Bahai or any other person who is a ‘non Muslim’ as described in Article 260 of the Constitution of the Islamic Republic of Pakistan 1973;

xiv) “Nomination day” means a day appointed under these rules for the nomination of candidates;

xv) “Ordinance” means the Punjab Local Government Elections Ordinance, 2000;

xvi) “Polling Agent” means a polling agent of a candidate appointed under these rules;

xvii) “Polling day” means the day on which poll is taken for election of member;

xviii) “Polling Officer” means a polling officer appointed under these rules;

xix) “Polling station” means a premises where arrangements are made for a poll.

xx) “Presiding Officer” means a presiding officer appointed under these rules and includes an Assistant Presiding Officer exercising powers and performing the functions of Presiding Officer;

xxi) Provincial Election Commissioner means the Provincial Election Commissioner, B.N.P.S;

xxii) “Publish” includes exhibition at a prominent place accessible to the public;

xxiii) “returned candidate” means a candidate who has been declared elected as member of Council or a Nazim or Naib Nazim o f Union Council, Tehsil/Town or District;

xxiv) “Returning Officer” means a returning officer appointed under these rules and includes Assistant Returning Officer exercising powers and performing functions of a Returning Officer;

xxv) “Rules” means Punjab Local Government Election Rules, 2000;

xxvi) “Validly nominated candidate” means a candidate whose nomination has been accepted under these rules;

xxvii) “withdrawal day” means a day fixed under these rules on or before which candidature may be withdrawn;

CHAPTER-II

CHIEF ELECTION COMMISSIONER

3. (1) The Chief Election Commissioner while assigning his powers and functions under sub-section (3) of section 12 of the Ordinance may specify the local areas wherein any of his officers shall exercise such powers.

(2) The Chief Election Commissioner or an officer appointed of authorized by him under the Ordinance of these rules, may by an order in writing, requisition any vehicle, vessel or animal as is needed or is likely to be needed for the purpose of transporting to and from any polling station, ballot boxes, election material, ballot papers or any officer or a person engaged for the performance of any duties in connection with the elections;
Provided that no vehicle, vessel, animal, which is being used by a candidate or his election agent for any purpose connected with the elections of such candidate, shall be so requisitioned.

(3) Where any vehicle, vessel or animal is requisitioned under sub-rule (2), there shall be paid to the owner thereof compensation, the amount of which shall be determined by the officer authorized by the Chief Election Commissioner to requisition the vehicle, vessel or animal on the basis of prevailing fair rates.

CHAPTER-III

ELECTORAL ROLLS

4. Supply of Electoral Rolls to the Returning Officer

(1) The Provincial Election Commissioner shall provide, to the Returning Officer for each union, copies of electoral rolls for all the electoral wards within that union.

(2) The Retuning Officer shall provide, to the Presiding Officer of each polling station, copies of electoral rules containing the names of the electors entitled to vote at that polling station.

(3) The returning officer shall consolidate the electoral rules according to the electoral wards of each union for which he is the Returning Officer, and display such rolls at his officer for public inspection at least three days before the date fixed for receipt of nominations.

(4) The Presiding Officer shall split up the electoral rolls for use at the polling booths within a polling station.

5. Supply of electoral rolls to the contesting candidates. – The contesting candidates may obtain attested photo copies of the electoral rolls of union from the concerned Registration Officer at heir own expense

6. Inspection of electoral rolls.- Every person shall have the right to inspect during office hours the electoral rolls of union by making an application in this behalf to the Registration Officer Concerned.

CHAPTER-IV

7. Directions for delimitation. The wards within a union shall be delimited in accordance with the directions issued by the Chief Election Commissioner from time to time.

8. Appointment of Delimitation Officer.

1) For the delimitation of electoral wards of a Union, the Chief Election Commissioner, or an officer authorized by him in this behalf under subsection (3) of section 12 of the Ordinance, shall appoint as many Delimitation Officers and Assistant Delimitation Officers as may be necessary to carry out the delimitation.

2) An Assistant Delimitation Officer shall assist the Delimitation Officer to the performance of his functions and subject to such instructions as may be given to him in this behalf by the Chief Election Commissioner may exercise and perform, under the control of the Delimitation Officer, the functions of the Delimitation Officer.

9. Preliminary list of wards. –

1) The electoral wards in the union shall be delimited having regard to the territorial unity as far as practicable, distribution of population and public convenience:
Provided that a Mauza or a Village in rural area and a Census 131ock in urban area shall not be broken.

2) A Delimitation Officer may, for the purpose of delimiting the electoral wards, make such inquiries and examine such record as he may deem necessary. .

3) The Delimitation Officer shall publish at his office a preliminary list of electoral wards delimited under rule 7, together with a notice, in the manner determined by the Chief Election Commissioner, for inviting objections and suggestions from the general public within such period as may be specified in the notice: Such notice shall also give the date on which the Appellate Authority shall decide objections and suggestions.

4) Any person entitled to vote in an election of a union may. within specified time, make a representation, objection or suggestion in respect of delimitation of electoral wards of that union to the Delimitation Officer or the Assistant Delimitation Officer. Objections received after the specified date shall be rejected.

5) Objections, or suggestions received within the specified period along with comments of the Delimitation Officer thereon shall be forwarded to the Appellate Authority on the day fixed for the purpose.

6) The Appellate Authority appointed by the Election Commissioner and notified in the Official Gazette, shall decide the

7) For the purpose of deciding objections, or suggestions the Appellate Authority may make such inquiries and examine such record as may be necessary;

8) The objections, representations or suggestions, if any, received shall be disposed of within specified time after providing an opportunity of hearing to the parties concerned.

10. Final list of wards. –

1) The Delimitation Officer shall make such amendments, alterations or modifications in the preliminary. list of electoral wards as may be required in the light of decisions of the Appellate Authority given on objections and/or suggestions.

2) After incorporating the decisions of the Appellate Authority in the preliminary list of electoral wards, the Delimitation Officer shall publish in the manner as determined by the Chief Election Commissioner the final list of electoral ward within each union specifying the areas included in each such wards.

3) The Chief Election Commissioner may, at any time, suo- motu or, an application made in this behalf order correction of any clerical error or any erroneous insertion or omission in the final list.

4) The list of electoral wards published under sub rule. (2) shall be final and no appeal shall lie there against.

CHAPTER-V
CONDUCT OF ELECTIONS

11. Assistance to the chief election commissioner.- The Chief Election Commissioner or the Officer authorized under sub section (3) of section 12 of the Ordinance may require any person or authority to perform such functions or render such assistance in connection with an election, in the councils or the areas as he may direct.

12. Appointment of District Retuning Officers and Returning Officers.-
1. Fort the purpose of an election, the Chief Election Commissioner shall appoint any Officer from amongst the officers performing functions in relation to the affairs of the Federal Government, a Provincial government or a Corporation controlled by any such government a District Returning Officer for each district and a Returning Officer for a ward or a group of wards in one or more local areas,

2. The Chief Election Commissioner may appoint, from amongst Officers performing functions in relation to the affairs of the Federal Government, a Provincial Government and a Corporation controlled by such government as many Assistant Retuning Officers as may be necessary.

3. Subject to the direction an control of the Chief Election Commissioner the District Returning Officer shall coordinate and supervise all work in the district in connection with the local Government elections and shall also perform such other duties and functions a may be entrusted to him by the Chief Election Commissioner.

4. It shall be the duty of a Returning Officer to do all such acts and things as may be necessary for the efficient conduct of an election in accordance with the provisions of the Ordinance and these rules and the instructions issued by the Chief Election Commissioner from time to time.

5. The Assistant Returning Officer shall assist the Returning Officer in the performance of his functions under the rules and may subject to such conditions imposed by the Chief Election Commissioner, exercise and perform under the control of the Returning Officer, the powers and functions of the Returning Officer.

13. Election Programme.-

1. The Chief Election Commissioner shall make programme for an election in Form I, hereinafter referred to as election programme.

2. The election programme under sub-rule (1) shall be published in the Official Gazette and posted at the Offices of the Returning Officers, Councils concerned, and such other places as the Chief Election Commissioner may direct.

3. The Chief Election Commissioner may at any time before the date of poll rescind the election programme published under sub-rule (2) and issue a revised programme of election in the official gazette.

14. Polling Stations.-

1. The Returning Officer shall before such time a may be fixed, submit to the District Returning Officer and the Officer Incharge of District Administration a list of polling stations which he proposes to provide in an electoral ward for the purpose of election of member or members for that ward.

2. The District Returning Officer may make such alterations in the list of polling stations submitted under sub-rules (1) as he may consider necessary.

3. The Returning Officer shall, at least four days before the polling day, publish the final list of polling stations, specifying the area and the electors entitled to vote at each polling station.

4. The Returning Officer shall provide each ward with polling stations according to the final list published under sub-rule (3).

5. No polling station shall be located in any such premises as belong to , or are under the control of any candidate.
Provided that a person who is , or has at any time been , in the employment of any candidate shall not be appointed as Presiding Officer or Polling Officer.

15. Presiding Officers and Polling Officers.-

1. The Returning Officer shall appoint for each polling station a Presiding Officer and such number of Assistant Presiding Officers and Polling Officers to assist the Presiding Officer as he may consider necessary;
Provided that a person who is , or has any time been, in the employment of any candidate shall not be appointed as a Presiding Officer, Assistant Presiding Officer or Polling Officer.

2. A list of such Presiding Officers and Poling Officers shall be submitted to the District Returning Officer.

3. A Presiding Officer shall conduct the poll in accordance with the provisions of the Ordinance and these rules and shall be responsible for maintaining order at the polling station and shall report to the Returning Officer any fact or incident which may, in his opinion, affect the fairness of the poll;
Provided that during the course of the poll the Presiding Officer may entrust such of his functions as may be specified be him to any Assistant Presiding Officer and it shall be the duty of the Assistant Presiding officer to perform the functions so entrusted.

4. The Returning Officer shall authorize one of the Assistant Presiding Officers to act in place of the Presiding Officer, if the Presiding Officer is at any time during the poll, by reason of illness or other cause, not present at the polling station, or is unable to perform his functions and any absence of the presiding officer, and the reasons therefore, shall as soon as possible after the close of the poll, be reported to the Returning Officer.

5. The Returning Officer may, at any time during the poll, for reasons to be recorded in writing, suspend any Presiding Officer, Assistant Presiding Officer or Polling Officer and make such arrangements as he may consider necessary for the performance of the functions of the officer so suspended.

16. Nomination for elections.-

1. The Returning Officer shall, as soon as may be, after the publication of election programme under rule 13, give a public notice in Form II inviting nominations and specifying the time before which and the place at which nomination papers shall be received by the Returning Officer.

2. Any elector of an electoral ward may purpose or second the name of any duly qualified person to be a candidate of becoming a member for that ward.

3. Every nomination of a candidate for becoming.-

i. A member in a union council shall be made by a separate nomination paper in Form –lll (A), which shall be signed by both the proposer and the seconder and shall, on solemn affirmation made by signed by the candidate.
ii. A Nazim and Naib Nazim of a union council, as joint candidates, shall be made by a separate nomination paper in Form—lll (B) a shall be signed by both the proposer and seconder and shall, on solemn affirmation made, be signed by both the candidates contesting election as joint candidates.
iii. A Nazim and a Naib Nazim of Zila Council or a Tehsil/Town council, as joint candidates, shall be made by a separate nomination paper in Form lll (c) and shall be signed by both the proposer an seconder and shall, on solemn affirmation made be signed by both the candidates contesting as joint candidates.
iv. Member of a Zila /Tehsil, or Town Council against seats reserved for Women, Peasants and Workers and Minority Communities shall be made in separate nomination paper in Form lll (D) and shall be signed by both the proposer and seconder and shall, on dolmen affirmation made be signed by the candidate.

4. Every nomination paper shall be accompanied by a declaration of assets of the candidate in Form-XIX, which shall be open to inspection by every voter of the local area concerned.

5. Every nomination paper shall be delivered by the candidate or his proposer or his seconder to the Returning Officer who shall acknowledge the receipt of the nomination paper specifying the date and time of receipt.

6. A person may be nominated in the same electoral ward by more than one nomination paper.

7. If any person subscribes as a proposer or a seconder to more than one nomination paper, all such nomination papers, except the one received by the Returning Officer, shall be void.

8. The Returning Officer shall assign a serial number to every nomination paper and endorse thereon the name of the person presenting it, and the date and time of its receipt, and inform such person of the time and place at which he shall hold scrutiny,

The Returning Officer shall cause to be affixed at some conspicuous place in his office a notice in Form IV of Every nomination paper received by him containing the particulars of each candidate and the names of the proposer and seconder as shown in the nomination paper for general information and inviting objections or suggestions from the voters of the local area within such time as may be specified in the Election Programme.

10. The objections or suggestions, if any, received under sub-rule (9) shall be taken into consideration at the time of scrutiny of nomination papers.

17 . Candidature fee.-

1. The nomination papers received under rule 16 shall not be accepted unless the amount prescribed in schedule-II is paid in cash or in the form of a bank draft in favor of the Provincial Election Commissioner Punjab by or on behalf of the candidate. The fee paid by or on behalf of the candidate shall be paid only once.

2. The cash deposits or a bank draft as the case may be received by the Returning officer shall be deposited by him at a government treasury or sub-treasury under the head of account “13000000- Miscellaneous Receipt 1390000- Others (NES) 1391200- Other Receipts fees funds and forfeitures 1391880- Other Receipts-Other (Election Receipts)”

3. The receipt for the payment of the candidature fee shall be issued in Form-V and the particulars entered in the register in Form-VI.

18. Scrutiny.-
1. The scrutiny of nomination papers shall be open to the candidates, their election agents, proposers and seconders, or the persons who made representations or objections against the nomination papers, and any voters of the local area concerned who obtains permission form the Returning Officer, before the commencement of the scrutiny, The Returning Officer shall give all those present reasonable opportunity for examining all nomination papers delivered to him under rule 16.

2. The Retuning Officer shall, in the presence of the persons attending the scrutiny under sub-rule (1), examine the nomination papers and decide any objection raised by any such person to any nomination.

3. The Returning Officer, may, either suo- moto or upon any objection, conduct such summary enquiry as he may think fit and reject a nomination paper if he is satisfied that:-

i. The candidate is not qualified to be elected as a member
ii. The propser or the seconder is not qualified to subscribe to the nomination paper;
iii. Any provision of rule 16 or rule 17 has no t been complied with ; or
iv. The signature or thumb impression of the propser or the seconder is not genuine.
Provided that in case of rejection of the nominations of either a Nazim or a Naib Nazim as joint candidates, the nomination as a whole for both the joint candidates shall stand rejected.

4. An appeal against the decision of the Retuning Officer under sub-rule (3) may be preferred by any person present at the time of scrutiny under sub-rule (1) to the Appellate Authority appointed for the purpose by the Chief Election Commissioner, and the decision of such Authority shall be final

19. Publication of list of candidates.-
1. The Returning Officer shall. After the scrutiny of nomination papers, Prepare n Form VII, a List of Validly nominated candidates and publish the same at some conspicuous place in his office.

2. Where an appeal is accepted, the name of the appellant shall be entered in the list of validly nominated candidates and the list so revised shall be republished.

3. A copy of list of validly nominated candidates published under sub-rule-(1) and (2) shall be furnished by the Returning Officer to the Provincial Election Commissioner or to such other officer as may be authorized by him for the purpose.

20. Withdrawal and Retirement.-

1. Any validly nominated candidate may, by notice in writhing signed by him and delivered on or before the withdrawal day to the Returning Officer, either by the candidate in person or by an agent authorized in this behalf in writing by such candidate , withdraw his candidature.
Provided that in case of joint candidates for the office of Nazim and Naib Nazim, the applications for withdrawal shall be signed by both.

2. On receiving a notice of withdrawal under sub-rule (1), the Returning Officer shall, if he is satisfied that the signature on the notice is that of the Candidate(s), cause a copy of the notice to be affixed at some conspicuous place in his office.

3. The Returning Officer shall, on the day next following the withdrawal day, prepare in Form-VIII a list of contesting candidates and publish the same at some conspicuous place in his office.
Provided that Form-VIII in respect of joint candidates for the office of Nazim and Naib Nazim shall be forwarded immediately to the Provincial Election Commissioner, Punjab as soon as possible.

4. Not with standing the publication of the list of contesting candidates under sub-rule(3), a contesting candidate may, in the manner prescribed in sub-rule(1) retire from the contest on any day not later than 72 hours ending the midnight before the day of poll.

5. The Returning Officer shall delete the name of the candidate who has retired from contest under sub-rule (4) from the list of contesting candidates already prepared in Form VIII and shall proceed to prepare a revised list in the manner prescribed in sub-rules (3)

6. The provisions of sub-rule (2) shall apply mutatis mutandis to the retirement form contest under sub-rule (4)

21. Death of candidate after nomination.-

1. If a validly nominated candidate who has not with drawn his candidature dies before taking of the poll, the Returning Officer shall, by public notice, terminate the proceedings relating to that election.

2. Where proceedings relating to an election have been terminated under sub-rules (1) fresh proceedings shall be commenced in accordance with the provisions of these rules as if for a new election.

22. Postponement etc., under certain circumstances. Where the proceeding relating to nomination, scrutiny or withdrawal cannot, for reasons beyond the control of the Returning Officer, take place on the day appointed therefore, he may postpone or adjourn such proceedings and shall, inform the District Returning Officer of his having done so where on the District Returning Officer shall fix another day for the proceedings so postponed or adjourned and, if necessary, also the day for days for any subsequent proceedings, in accordance with the directions of the Chief Election Commissioner.

23. Uncontested election.-

1. Where, after scrutiny under rule 18 only such number of persons remain as validly nominated candidates as are equal to the number of members to be elected form a Ward or Where after withdrawal or retirement under rule 20 only such number of persons is left as contesting candidates as are equal to the number of members to be elected from a Ward the Returning Officer shall by public notice, declare such candidates to be elected to the seats:
Provided that if after scrutiny any candidate indicates that he intends to file an appeal under sub-rule (4) 18 against the rejection of his nomination paper, no person shall be declared elected until the period for filing such appeal has expired and no such appeal has been filed or where an appeal is filed, until the disposal of such appeal.

2. The Returning Officer shall submit to the District Returning Officer, a return of the election In respect of which he has made a declaration under sub-rule (1).

3. On receipt of return under sub-rule (2) the District Returning Officer, shall cause to be published in the official Gazette the names of the returned candidates.

24. Contested election.-

1. If there are more contesting candidates than the number of seats in respect of any ward, the Returning office, shall.

i. Allocate, subject to any direction of the Chief Election Commissioner or a District Retuning Officer, one of the symbols contained in Schedule-1 to each contesting candidate, and in so doing shall, so far as possible have regard for any preference indicated by the candidate:
Provided that if in any ward the number of contesting candidates exceeds the number of symbols given in the schedule referred to in clause (i) of sub-rule (1), the Returning Officer may, with the approval of the District Returning Officer, introduce additional symbols before the date fixed for allotment of symbols.
ii. Publish the name of contesting candidates arranged in the English alphabetical order specifying against each the symbol allocated to him in Form-VIII; and
iii. Give public notice of the poll in Form IX.

2. The Returning Officer shall arrange to exhibit prominently at each polling station the name and symbol of each contesting candidate.

25. Election agent.-

1. A candidate may appoint a person qualified to be elected as a member, to be his election agent.

2. The appointment of an election agent may, at any time, be revoked in writing by the candidate and, when it is so revoked or the election agent dies, another person may be appointed by the candidate to be his election agent.

3. When an election agent is appointed, the candidate shall send to the Returning Officer a notice in writing of the appointment containing the name, father’s name, and address and specimen signatures of the election agent.

4. Where no appointment of an election agent is made under this rule, a candidate shall be deemed to be his own election agent and shall so far as the circumstances permit, be subject to the provisions of these rules both as a candidate and election agent.

26. Polling agent.-

1. The contesting candidate or his election agent, may, before the commencement of the poll, appoint under intimation to the Presiding Officer polling agents for each polling station; provided that the polling agents shall be the electors of that area and their number shall not, exceed the number of polling booths.

2. The appointment of a polling agent under sub-rules (1), may at any time be revoked by the candidate or his election agent and when it is so revoked or the polling agent dies, another person may be appointed by the candidate or the election agent to be a polling agent; and a notice of such appointment shall be given to the Presiding Officer.

27. Absence of candidates etc. not to invalidate acts etc.- Where any act or thing is authorized by these rules to be done in the presence of the candidate, an election agent or a polling agent, the failure of such person to attend at the time and place appointed for the purpose shall not invalidate any act or thing otherwise validly done.

28. Hours of the poll.- The Returning Officer shall, subject to any direction of the District Returning Officer, fix the hours during which the poll shall be taken and give a public notice in Form IX of the yours so fixed,

29. Stopping of poll,-

(1) The Presiding Officer of a polling station shall stop the poll and inform the Returning Officer that he has done so if.

i. the poll at the polling station is , at any time so interrupted or obstructed for reasons beyond the control of the Presiding Officer that it cannot be resumed during the a polling hours fixed under rule 28; or
ii. any ballot box used at the polling station is unlawfully taken out of the custody of the presiding officer, or is accidentally of intentionally destroyed or lost, or is damaged or tampered with to such an extent that the results of the poll at the polling station cannot be ascertained.

(2) Where a poll has been stopped under sub-rules (1), the Returning Officer shall immediately report the circumstances to the District Returning Officer, who shall direct a fresh poll at that polling station and fix a date for such polls, unless he is satisfied that the result of the election has been determined by the polling that has already taken place at that polling station taken with the results or the polling at other poling stations in the same electoral ward.

(3) Where an order under sub-section (2) has been made, the Returning Officer shall notify the day for a fresh poll and fix the place at which and the hours during which such fresh poll shall be taken.

(4) At a fresh poll taken under sub-rule (3) at a polling station, all electors entitled to vote there to shall be allowed to vote and no vote cast at the poll stopped under sub-rule (1) shall be counted; and the provisions of the Ordinance and the rules hall apply to such fresh poll.

35. Ballot boxes.-

1) The Provincial Election Commissioner shall prove each returning Officer with such member of ballot boxes as may be necessary.
2) In the elections of the union councils, there shall be one or more ballot boxes at each booth as may be determined by the Chief Election Commissioner, for casting of votes for candidates belonging to the following categories;-
Muslim Candidates (Male & Female)
Candidates for seats reserved for peasants /workers
(Male/Women)
Minority communities and Nazim and Naib Nazim contesting elections as joint candidates.

3) The Returning Officer shall further provide each Presiding Officer with such additional number of ballot boxes as may be necessary.

4) Not more than one ballot box shall be used for each of the categories enumerated in sub-rules (2) at a time for the purpose of the poll at any polling station, or at any polling booth, where there are more than one polling booths at a polling station.

5) At least half an hour before the time fixed for the commencement of the poll, the presiding officer shall—

i. ensure that every ballot box to be used is empty;
ii. Show the empty ballot box to the contesting candidates and their election agents and polling agents, whoever may be present and record their statements in this behalf and obtain their signatures thereon.
iii. After the ballot box has been shown to be empty , close and seal it with hi sown seal and with the seals of such or the candidates, or their election agents or polling agents as may be present any may desire to put their own seals on it; and
iv. Place the ballot box so as to be conveniently accessible to the electors, and at the same time within his view and with in the view of such candidates or their election or polling agents as may be present.

6) If one ballot box is full or cannot further be used for receiving ballot papers, the Presiding Officer shall seal that ballot box and keep it in a secure place and use another ballot box in the manner laid down in sub-rule (4)

7) A Presiding Officer shall make such arrangements at the polling stations that every elector may be able to mark his ballot paper in secret before the same is folded and inserted in the ballot box.

31. Admission to polling station. – The presiding Officer shall, subject to such instructions as the Chief Election Commissioner or a District Returning Officer or Returning Officer may give in this behalf, regulate the number of electors to be admitted to the polling station at a time and exclude form the polling station all other persons except–

a. any person on duty connection with the election.
b. The contesting candidates, their election agents and polling agents; and
c. Such other persons as may be specifically permitted by the Returning Officer.

32. Maintenance of order at the polling station.-
1) The Presiding Officer shall keep order at the polling station and may remove or cause to be removed any person who commits misconduct at the polling station or fails to obey any lawful orders of the presiding Officer.

2) any person removed under sub-rules (1) forma polling station shall not , without the permission of the Presiding Officer, again enter the polling station during the poll and shall if he is accused of an offence polling station , be liable to be arrested without warrant by a police order.

3) The powers under sub-rules (2) shall be so exercised not to deprive an elector of an opportunity to cast his vote at the polling station at which he is entitled to vote.

33. Election by secret ballot.- An election under these rules shall be decided by secret balloted voter shall cast his voter by inserting, in accordance with the provisions of these rules in the ballot box, a ballot paper which shall be inform-X(A), X (B),X(C) or X (D) and bear the common symbols which shall include those of the contesting candidate.

34. Voting procedure.-

1) Where the elector presents himself at the polling station to vote, he shall show his national identity card to the presiding Officer, who shall after satisfying himself about the identity of the elector issue him ballot papers.
Provided that the elector will not be issued more than one ballot paper each of different color for different categories of candidates to be determined by the chief Election Commissioner

2) Before a ballot paper is issued to an elector—

i. the number and name of the elector as entered in the electoral roll shall be called out
ii. a mark shall be placed on the electoral roll against the number and name of the elector to indicate that ballot paper has been issued to him;
iii. the ballot paper shall on its back be stamped with the official mark and signed by the Presiding Officer; and
iv. the number of the elector on the electoral roll shall be written on the counterfoil by the Presiding Officer who shall also stamp the counterfoil with the official mark and also obtain the thumb impression of the elector on the counterfoil..

3) a ballot paper or ballet papers shall not be issued to a person who refuses or is unable to produced a national identity card.

4) if a contesting candidate or his election or polling agent alleges that an elector to whom a ballot paper or ballot papers are about to be issued already has one or more ballot papers in his possession., the Presiding Officer may require the elector to satisfy him that he does not have any other ballot paper in his possession and may also take such measures as he thinks fit to ensure that such elector does not insert more ballot papers that issued to him in the ballot box.

5) where an elector is blend or physically other-wise so incapacitated that he cannot vote without the assistance of a companion, the Presiding Officer shall allow him to be accompanied by a companion not being a candidate or agent of a candidate and in case the disability is such that elector cannot mark the ballot paper or ballot papers himself, the person accompanying the elector may mark the ballot paper as indicated by him.

6) The elector, on receiving the ballot paper or ballot paper, shall—

I. Forthwith proceed to the place reserved for marking the ballot paper;
II. put the marking aid rubber stamp on the ballot paper at place within the space containing the symbol of contesting candidate of his choice; and
III. After he has so marked the ballot paper fold and insert it in the ballot box.

7) The elector shall vote without undue delay and shall leave the polling station immediately after he has inserted his ballot paper or ballot papers in the ballot box.

35. Tendered ballot paper. –

1) If a person representing himself to be an elector applies for a ballot paper when another person has already represented himself to be that elector and has voted under the name of the person so applying, he shall be entitled, subject to the provisions of this rule to receive a ballot paper (hereinafter referred to as “tendered ballot paper”) in the same manner as any other elector.

2) a tendered ballot paper shall, instead of being put into the ballot box, be given to the Presiding Officer who shall endorse there on the name and number in the electoral roll of the person applying of it and place it is a separate packet bearing the label ”Tendered Ballot Paper”.

3) The name of the person applying for a ballot paper under sub-rule (1) and his number on the electoral roll shall be entered in a list (hereinafter referred to as the tendered votes list) to be prepared in form XI by the Presiding Officer.

36. Challenge of electors.-

1) If, at the time a person appeals for a ballot paper for the purpose of voting, a candidate or his polling agent declares to the Presiding Officer that he has reasonable cause to believe that, this person has already voted at the election, at the same or another polling station, or is not the person whose name is entered in the in the electoral roll against which he is seeking to vote, and under takes to prove the charge in a court of law and deposit is with the Presiding Officer in cash a sum of Rs. 10/- for each such challenge the Presiding Officer may, after warning the person of the consequences and obtaining his thumb impression and, if he is literate, also his signature on the counterfoil, issue as ballot paper ( hereinafter referred to as challenged ballot paper) to that person.

2) If the presiding officer issues a ballot paper under sub-rule (1) to such person he shall enter the name and address of that person in a list to be prepared by him (hereinafter referred to as the challenged votes list) inform XII, an obtain thereon the thumb impression and, if he is literate, also the signature of that person.

3) A ballot paper issued under rule (1) shall, after it has been marked and folded by the elector, be placed in the same condition in a separate packet bearing the label “Challenged Ballot Paper”’ instead of being placed in the ballot box.

37. Spoilt ballot paper.-

1) An elector who has inadvertently so spoilt his ballot paper that it cannot be used as a valid ballot paper may, upon proving the fact of inadvertence to the satisfaction of the Presiding Officer and returning the ballot paper to him, obtain an other ballot paper and cast his vote by such other ballot paper.

2) The Presiding Officer shall forthwith cancel the ballot paper returned to him under sub-rule (1), make a note to that effect on the counterfoil over his own signature an sing the cancelled ballot paper and place it in a separate packet labeled “Spoilt Ballot Papers”,

3) If a ballot paper issued to an elector has not elector has not been inserted by him into the ballot box and is found any where in or near the polling station, it shall be cancelled and also accounted for as “spoilt ballot paper”.

38. Voting after close of poll.- no person shall be given any ballot paper or be permitted to vote after the hour fixed for the close of the poll, except the persons who at that hour are present within the building, room, tent or enclosure in which is the polling station is situated and have not voted but are waiting to vote.

39. Proceeding at the close of the poll.-

1) The presiding officer shall count the votes immediately after the close of the of the poll, in the presence of such of the contesting candidates, election agents and polling agents as may be present.

2) The presiding officer shall give such of the contesting candidates, election agents and polling agents as may be present, reasonable facility of observing the count and give them such information with respect thereto as can be given consistent with the orderly conduct of the count and the discharge of his duties in connection therewith.

3) No person other than the Presiding Officer and polling Officer, any other person on duty in connection with the poll, the contesting candidates, their election agents and polling agents shall be present at the count.

4) The presiding officer shall—

IV. Open the used ballot box or ballot boxes and count the entire lot of ballot papers taken out there from
V. Open the packet labeled “challenged ballot paper” and include the ballot papers therein in the count.
VI. Count the votes cast in favour of each contesting candidate of each contesting candidate excluding from the count the ballot papers which bear—

a. no official mark
b. any writing or any mark other than the official mark and the mark of “marking aid rubber stamp” or which a piece of paper or any other object of any kind has been attached;
c. no mark of “marking aid rubber stamp” or to which a piece of paper or any other object of any kind has been attached;
d. any mark from which it is not clear for whom the elector has voted;
Provided that a ballot paper shall be deemed to have been marked in favour of a candidate if the whole or more than half of the area of the mark of “ marking aid rubber stamp” appears clearly within the space containing the symbol of that candidate;
e. and where the mark of “marking aid rubber stamp” is divided equally between two such spaces, the ballot paper shall be deemed to be invalid,

5) the presiding Officer may recount the votes.—
VII. of his own motion it he considers it necessary; or
VIII. upon the request of a contesting candidate or an election agent present, if, in his opinion, the request is not unreasonable.

6) The valid ballot papers cast in favour of each contesting candidate shall be put in separate packets and each such packet shall be sealed and shall contain a certificate as to the number of ballot paper put in it and shall also indicate the nature of the contents there of, specifying the name and symbol of the contesting candidate to whom the packet relates.

7) The ballot papers excluded from the count shall be put In a separate packet indicating there on the total number of ballot papers contained therein.

8) The packets mentioned in sub-rules (6) and (7) shall be put in a principal packet which shall be sealed by the Presiding Officer.

9) The presiding Officer shall, immediately after the count , prepare a statement of the count in Form-XIII showing therein the number of valid votes polled by each contesting candidate and the ballot papers excluded from the count.

10) The Presiding Officer shall also prepare in Form XIV a ballot paper account showing separately—

I. The number of ballot papers entrusted to him;
II. The number of ballot papers taken out of the ballot box or boxes and counted;
III. The number of tendered ballot papers;
IV. The number of challenged ballot papers;
V. The number of spoilt ballot papers; and
VI. The number of un-issued ballot papers.

11) The Presiding Officer shall if so requested by any candidate or election agent or polling agent present, give to him a certified copy of the statement of the count and the ballot paper account.

12) The President Officer shall seal in separate packets.

I. the un-issued ballot papers;
II. the spoilt ballot papers
III. the tendered ballot papers;
IV. the challenged ballot papers;
V. the marked copies of the electoral rolls;
VI. the counterfoils of the used ballot papers;
VII. the tendered votes’ list;
VIII. the challenged votes’ list; and
IX. such other papers as the Returning Officer may direct.

13) The President Officer shall obtain on each statement and packet prepared under this rule the signatures of such of the contesting candidates or their election agents or polling agents as may desire to sign it.

14) A person entitled to sign a packet or statement under sub-rule (13), may, if he so desires, also affix his seal on it.

15) After the close of the proceedings under the foregoing sub-rules, the Presiding Officer, shall, in compliance with such instructions as may be given by the returning Officer in this behalf, cause the packets, the statement of the count and the ballot paper account prepared by him to be sent to the Returning Officer together with such other records as the Returning officer may direct.

40. Consolidation of results.-

1) The Returning Officer, shall consolidate in From XV the results or counts furnished by the Presiding Officer.

2) The Returning Officer shall give the contesting and their election agents a notice in writing of the day, time and place for the consolidation of the results.

3) Before consolidating the results of the count, the Returning Officer shall examine the ballot papers excluded form the count by the Presiding Officer and if he finds that any such ballot paper should not have been so excluded, count it as a ballot paper cast in favour of the contesting candidate for whom the vote has been cast thereby.

4) The Returning officer shall include the votes cast in favour of each contesting candidate in the consolidated statement except those which he may reject on any of the grounds mentioned in clause (III) sub-rule (4) of rule 39.

5) The ballot papers rejected by the Returning officer under sub-rule (4) shall be shown separately on the consolidated statement.

6) The Returning shall not recount the valid ballot papers in respect of any polling station unless—

I. the count by the Presiding Officer is challenged in writing by a contesting candidate or his election agent and the Returning Officer is satisfied about the reasonableness of the challenge; or
II. he is directed to do so by the Chief Election Commissioner or the District Returning Officer.

41. Equality of votes

1) Where after consolidation of the results of the count under rule 40, except for the offices of Zila Nazims and Naib Zila Nazims as joint candidates securing highest votes but not securing majority of total votes of a members of Union Councils, it is found that there is equality of votes between two or more contesting candidates and the addition of one vote for one such candidate would entitled him to be declared elected, the Returning Officer shall forthwith draw a lot in respect of such candidates, and the candidates on whom the lot falls shall be deemed to have received the highest number of votes. Entitling him to be declared elected.
2) The lot shall be drawn in the presence of such of the contesting candidates and their election agents as may be present.

3) The returning officer shall keep a record of the proceedings in writing, and obtain thereon the signatures of such candidates and election agents as have been witnesses to the proceedings.

42. Declaration of results.-

1) Save as provided in sub-rule (4) of rule 39 the returning officer shall, after consolidation of results under rule 40, or after the drawal of the lot under rule 41, declare by public notice, the names of such contesting candidate, or candidates in case of multi-members wards as have or are deemed to have received the highest number of votes.

2) The public notice shall contain the name of and the total number of votes received by each contesting candidate.

3) The returning Officer shall, immediately after publication of the notice under sub-rule (1) submit to the District Returning Officer, a return of the election in Form-XVI together with a copy of the consolidated statement.

4) In case of elections of Nazim and Naib Nazim if the joint candidates of a Zila council securing highest votes fail to secure majority of the total votes of the members of Union Councils in the district the names of joint candidates securing the highest and the second highest votes shall be sent to the chief Election Commissioner, immediately after the consolidation of results in Form-XVI.

5) The District Returning Officer shall arrange to have names of the returned candidates of an electoral ward in a council published in the official Gazette.

CHAPTER VI

OATHOF OFFICE

43. Oath of office.-

1. After the names of the members, Nazim and Naib Nazim of a Union Council and the names of the members elected against seats reserved for women, peasants and workers and minority communities in Zila Council and Tehsil Council are notified the District Returning Officer shall notify a programme of oath of office of these elected members, Nazims and Naib Nazims.

2. For administering oath of office to the members, Nazims and Naib Nazims under sub-rule (1), the chief Election Commissioner shall appoint for each District presiding officer and as many Assistant Presiding Officers as may be necessary.

3. The Assistant Presiding Officers shall perform any or all of the functions of the Presiding Officer as are entrusted to him by the Chief Election Commissioner or Presiding Officers, under the supervisions and guidance of the Presiding Officer.

4. The Presiding Officer appointed under sub-rule (2) shall give notice to the elected members, Nazims and Naib Nazims of each Union Council, Tehsil/Town Council and members of Zila Council to assemble at appointed place or places to take oath of office and shall ensure that such notice is delivered to all persons eligible to take oath.

5. The notice issued under sub-rule (3) shall specify the time, date and place or places where the members, Nazims and Naib Nazims of each Union Council, or members of the Zila Council and each of the Tehsil/Town Councils eligible for take in oath shall assemble. The notice shall gibe the name an designation of the Assistant Presiding Officer or the Presiding Officer who shall preside the proceedings in a council.

6. All members, Nazims and Naib Nazims shall assemble and attend the proceeding of the oath of office held under sub-rule (4) given oath in Form prescribed in Schedule –III

7. As soon may be after the assembly of the members under sub-rule (6), such member, Nazims and Naib Nazims who could not take oath under sub-rule (6) shall take oath to office before the Presiding Officer or and Assistant Presiding Officer nominated by the Presiding Officer from amongst the officers appointed under sub-rule (2). The Presiding Officer may notify the programme of a fresh assembly, if the number of members, Nazims and Naib Nazims to be given oath so justifies

8. After taking the oath of office the form of oath in Schedule III shall be signed by the persons taking oath and shall be countersigned by the Presiding Officer or the concerned Assistant presiding Officer. A list of persons taking oath shall be forwarded to the Provincial election Commissioner Punjab.

9. All the forms of the oath of office shall be kept in record of the Council.

CHAPTER VII

ELECTION OF ZILA NAZIM AND NAIB ZILA NAIZM TEHSIL/TOWN NAIZM AND TEHSIL /TOWN NAIB NAZIM AND MEMBERS OF ZILA COUNCIL AND TEHSIL/TOWN COUNCILS AGAINSTSEATS RESERVED FOR WOMEN, PEASANTS /WORKERS AND MINORITY COMMUNITIES

44. Subject to the provisions of the Ordinance and the Punjab Local Government Election Rules 2000, the Chief Election Commissioner shall organize and conduct the election of Zila Nazims, Naib Zila Nazims, Tehsil/Town Nazims, Naib Tehsil/Town Nazims and members of Zila Councils and Tehsil Councils against seats reserved for women, peasants/workers and minority communities, in the manner hereunder prescribed.

45. For the purpose of elections under rule 45 the Chief Election Commissioner shall appoint as many Returning Officers and Presiding Officers as may be necessary.

46. The returning Officer may appoint such number of polling Officers as may be necessary.

47. Duties of Returning Officers. A Returning Officer shall conduct the poll of Nazim and Naib Nazim as joint candidates and members against seats reserved for women, peasants, workers and minority communities in the Zila council and Tehsil/Town Council in accordance with the Ordinance and the Punjab Local Government Elections Rules 2000, and may exercise such powers and perform such functions as are necessary for the free, fair and honest elections and guard against any corrupt practices.

48. The Returning Officer may through a written order authorize any Presiding Officer to perform such of his functions and exercise such powers for the conduct of elections, as may be specified by him.

49. The Returning officer may, at any time during the poll, for reasons to be recorded, suspend any Presiding Officer and make such arrangements, as he may consider necessary.

50. List of Voters.-

1. The list of elected members eligible to vote for the election of a Zila Nazim and a Naib Zila Nazim, a Tehsil Nazim and a Naib Tehsil Nazim, and a Town Nazim and a Naib Town Nazim shall be provided to the Returning Officer by the Provincial Election Commissioner, Punjab.

2. The number of women, peasants and workers, and members belonging to minority communities in Zila Council or a Tehsil/Town Council shall be determined and notified by the Chief Election Commissioner.

51. Programme of Election For the purpose of Elections, the Chief Election Commissioner shall by notification in official Gazette call upon the members of the union councils concerned to elect—

1. a Zila Nazim and a Naib Zila Nazim for a district as joint candidates;

2. a Tehsil Nazim and a Naib Tehsil Nazim, a Town Nazim and a Naib Town Nazim for each Tehsil or Town as joint candidates, as the case may be; and

3. for a Zila Council and each Tehsil Council or Town Council, the members against seats reserved for women, peasants and workers, and minority communities.

52. Issues of notifications.- The programme notified under rule 52 may specify;-

1. A day on which nominations may be filed.

2. A day on which scrutiny of nomination may take place.

3. A day on which candidature may be withdrawn.

4. A day for taking the polls and

5. A day on which results may be announced.

53. Nomination for Election;- Subject to the provisions of the Ordinance, a member of an electoral college concerned may propose or second the names of persons who are enrolled as voters in the local area concerned to be candidates for election of a Zila Nazim and a Naib Zila Nazim, a Tehsil Nazim as joint candidate, or a member against seats reserved for women, peasants and workers, and minority communities for the relevant Zila Council or a Tehsil Council or a Town Council.

54. The Returning Officer shall notify the name of Presiding Officer the time and place separately for each council, where voters of that council shall vote.

55. Except for declaration of election results of Zila Nazim and Naib Zila Nazim of a District securing highest votes but not securing majority of the total votes of the numbers the electoral college concerned, all the other provisions of the Ordinance and these rules shall mutatis mutandis apply to the election of Nazims, and the Naib Nazims of Zila/Tehsil/Town councils and members to be elected against seats reserved for women, peasants and workers, and persons belonging to minority communities in the Zila Councils and the Tehsil Councils and Town Councils.

56. In case any joint candidates for a Zila Nazim and Naib Zila Nazim, who failed to secure majority of total votes of the number of members of Union councils in the districts, and as such were not entitled to be declared elected, the result of the count shall be reported to the Chief Election Commissioner.

57. On the receipt of the result to count under rule 57 the Chief Election Commissioner shall notify fresh election programme in which the joint candidates securing the highest and the second highest number of votes shall contestants.

58. The joint Candidates securing the highest number of votes in the fresh election under rule 58 shall declared elected as Zila Nazims and Naib Zila Nazims.

59. The District Returning Officer shall notify the names of returned Zila Nazim and Naib Nazim and administrator oath to them, according to the programme notified by him.

60. Copies of notifications issued under rule 60 shall be sent to the Chief Election Commissioner and the Provincial Election Commissioner Punjab.

CHAPTER – VIII

RESPONSIBILITIES OF RETURNING OFFICERS AFTER THE POLL

61. Issue of Identity Cards.-

1. The Provincial Election Commissioner Punjab through the Returning Officers concerned will arrange to issue identity cards to members, Nazims and Naib Nazims elected to a council as soon as they have taken oath of their office.

2. The Identity Cards shall be in such form as may be determined by the chief Election Commissioner.

62. Resealing of Packets and supply of Copies.- The returning officer shall,

1. immediately after preparing the consolidated statement and the return of elections, reseal packets and statements opened by him for the purpose of consolidation, remitting such of the candidates and their election agents as may be present to sign the packets and affix their seals to such packets if they so desire; and

2. supply duly attested copies of the consol.

63. Documents to be sent and to be retained by the Officer authorized by the Chief Election Commissioner.-

1. The Returning Officer shall under intimation to the Provincial Election Commissioner forward to the Officer authorized by the Chief Election Commissioner.
2002 packets containing the ballot papers each of which shall be sealed with the of the Presiding officer, or. If opened by the Returning Officer, with the seal of the Returning Officer.
ii) Packets containing the counterfoils of issued ballot papers;
iii) The packets containing the marked copies of the electoral rolls;
iv) The packets containing the ballot paper account.
2003 A packet containing the tendered ballot papers. The challenged ballot papers. The tendered votes list and the challenged votes list; and
vi) Such other papers as the Chief Election Commissioner may direct.

2. The returning Officer shall endorse on each packet forwarded under sub-rule (1) the description of its contents, the date of the election to which the contests relate the name of the electoral unit or ward for which the election was held.

3. the District Returning Officer shall retain the documents contained in the packets received under sub-rule (1), for period of one year from the date of their receipt, and thereafter shall, unless otherwise directed by the Provincial Election Commissioner or a Tribunal, cause these to be destroyed,

4. the documents received under sub rule (3) shall be kept in the safe custody in a treasury of such place as is directed by the Chief Election Commissioner.

64. Public Inspection of Documents. The documents retained under rule 64 (3) except the ballot papers., shall be open to public inspection at such time and subject to such conditions as may be specified by the Provincial Election Commissioner, upon an application made in this behalf and on payment of such fee as may be fixed by the Provincial Election Commissioner, Copies of , or extracts from those documents may be obtained by any voter of the local area, on written application and payment of fees determined by the Provincial Election Commissioner.

65. Order of production of documents.

1. A Tribunal may order the opening of packets of counterfoils and certificates or the inspection of any accounted ballot papers.

2. An order under sub rule (1), may be made subject to such conditions as to persons, time, place and made of inspection, production of documents and opening a of packets as the Tribunal making the order may think expedient;
Provided that in making and carrying into effect an order for the inspection of counted ballot papers, care shall be taken that on vote shall be disclosed until it has been held by the Tribunal to be invalid.

3. where an order is made under sub-rule (1) the production by the Returning Officer of any documents in such manner as may be directed by the order shall be conclusive evidence that the document relates to the election specified in the order, and any endorsement or any packet of ballot papers so produced shall be prima facie evidence that the ballot papers are what the endorsement states them to be.

4. the production form proper custody of a ballot paper purporting to have been used at an election, and of a counterfoil having a number, shall be prima facie evidence that the elector whose vote was given by the at ballot paper was the elector whose identity card number was written on the counterfoil.

5. Save as provided in this rule, no person shall be allowed to inspect any rejected or counted ballot paper.

CHPTER-IX

ELECTION EXPENSES

66. Definition of Election Expenses. —In this Chapter, “election expenses”, means any expenditure incurred or payment made, whether by way of gift, loan advance, deposit or otherwise, for the arrangement, conduct or benefit of, or in connection with, or incidental of the election of candidate including the expenditure on account of issuing circulars or publications or otherwise presenting to the electors, the candidate or his views, aims or objects; but does not include the deposit made under rule 17.

67. Restriction of election expenses. —No candidate shall incur expenses on his election exceeding the amount prescribed in Schedule-IV.

68. Statement of Election Expenses. –

1. Every contesting candidate shall, within thirty-five days after the publication of the name of the returned candidates submit to the Returning Officer a statement of election expenses in Form XVII containing:-

i. an account of all payments made by the contesting candidate together with all the bills and receipts;
ii. an account of all disputed claims of which the contesting candidate is aware:
iii. an account of all unpaid claims, if any, which the election agent for contesting candidate is aware; and
iv. an account of all money , securities or equivalent of money received form any person for the purpose of election expenses specifying the name of every such person.

2. the statement submitted under sub-rule (1), shall be accompanied by an affidavit in Form XVIII sworn by the contesting candidate.

69. Inspection of statements etc. –

1. The statement and documents submitted under rule 69 shall be kept by the Returning Officer in his office or at other such convenient place as he may think fit and shall, during one year from the date of their receipt by him , keep open to inspection by any person on payment of fee as may from time to time fixed by the Chief Election Commissioner.

2. The Returning officer shall, on an application made in this behalf and on payment of fee as may from time to time be fixed by the Chief Election Commissioner, give any person copies of any statement or document kept under sub-rule (1) or of any part thereof.

CHAPTER X

ELECTION DISPUTES

70. Election Petition. –

1. No election shall be called in question except by an election petition made by a candidate for that election (hereinafter referred to as the petitioner)

2. An election petition shall be presented to the Tribunal appointed by the Chief Election Commissioner within thirty days of the publication in the official Gazette the name of the returned candidate and shall be accompanied by a receipt showing that the petitioner has deposited in a Scheduled Bank in favour of the Chief Election Commissioner, a sum of one thousand rupees, as fee fro the petition
[the Chief Election Commissioner has been pleased to prescribe the following head of accent for depositing the fees for election petition.
1300000-Miscellaneous Receipt 1390000-Others (NES 1391200-Other Receipts fees funds and forfeitures 1391800-Other Receipts (NES) 1391880-Other Receipts-Other( Elections Receipts)”.]

3. An election petition shall be presented by a petitioner and shall be deemed to have been presented, when it is delivered in person by the petitioner, or by a person authorized in this behalf by him, to the tribunal appointed by the Chief Election Commissioner for the purpose.

71. Parties to the petition. –The petitioner shall join all contesting candidates as respondents to his election petition and shall serve personally or by registered post (AD) on each respondent a copy of his petition

72. Contents of petition. –
1. Every election petition shall contain.-

i. A precise statement of the material facts on which the petitioner relies:
ii. Full particulars of any corrupt or illegal practice or other illegal act alleged to have been committed, including as full as possible a statement of the names of the parties alleged to have committed such corrupt or illegal practice of illegal act and the date and place of the commission of such practice or act: and
iii. The relief claimed by the petitioner.

2. A petitioner may claim as relief any of the following declarations namely:-

i. That the election of the returned candidate is void and that the petitioner of some other person has been duly elected. Or
ii. That the election as a whole is void.

3. Every election petition and every schedule or annex to that petition shall be signed by the petitioner and verified in the manner laid down in the Code of Civil Procedure, 1908, for the verification of the pleadings.

73. Appointment of Tribunal.-

1. For the trial of election petitions under these rules, the Chief Election Commissioner may appoint as many Election Tribunals as may be necessary.

2. A tribunal shall consist of a person who is or has been a District and Sessions Judge or Additional District and Sessions Judge or a Senior Civil Judge.

74. Place of trial.- The trial of an election petition shall be held at such place or places as the Tribunal may think fit.

75. Appearance before Tribunal. – Any appearance, application or act before a Tribunal may be made or done by a party in person or through an advocate.
Provided that the Tribunal may, where it considers necessary, direct any party to appear in person.

76. Procedure before Tribunal. –

1. Subject to the provisions of the Punjab Local Government Elections Ordinance, 2000. And these rules every election petition shall be tried, as nearly as may be, in accordance with the procedure for the trial of suits under the Code of Civil Procedure, 1908 (Act V of 1908)

a. Where the election petition claims as relief a declaration that election of the returned candidate is void on the ground that the returned candidate was not, on the nomination day, qualified for , or was disqualified from, being elected as a member, decide the question of such qualification or disqualification as preliminary issue:
b. Require the parties to file within fifteen days of the date on which the case is fixed for evidence, a list of witnesses whom they purpose to produce to five evidence or to produce documents, mentioning against the name of each witness a précis of the evidence that each witness is expected to give;
c. Make memorandum of the substance of the evidence of each witness as his examination proceeds unless it considers that there is a special reason for taking go down the evidence of any witness in full;
d. Refuse to examine a witness if it considers that his evidence is not material or that he has been called on a frivolous or vexatious ground, for the purpose of delaying the proceedings or defeating the ends of justice; and
e. Refuse to issue any summons for the appearance of any witness unless, within three days following the date on which the parties are called upon to produce their evidence; any party intimates the Tribunal that it desires a witness to be summoned through the Tribunal and the Tribunal is satisfied that it is not possible or practicable for such party to produce the evidence.

2. The Tribunal may permit the evidence of any witness to be given by means of an affidavit:
Provided that if the Tribunal deems fit, it may call such witness for the purpose of examination before it.
3. Subject to e provisions of the Punjab Local Government Elections Ordinance, 2000. and these rules the Qanun-E-Shahadat 1984 shall apply to the trial of an election petition.

4. the Tribunal may, at any time, upon such terms and on payment of such costs as it may direct, allow a petition to be amended in such a manner as may, in its opinion, be necessary for ensuring a fair and effective trial and for determining the real questions in controversy, so however that no new ground of challenge to the lection is permitted to be raised.

R. 76— Civil procedure Code (V of 1908), O. XIV , R. 1—Election petition—Non-framing of issues – parties without any objection participated in the trial, examined their witnesses and cross-examined them—None of the parties took the exception that because of non-framing of issues, the trial could not proceed—Effect—Where the parties were well-aware as to what was the exact nature of controversy between them and what facts were required to be proved or disproved, Non-framing of specific issues had not caused any prejudice to the parties in circumstances. PLD 2003 Lah. 35
Failure to direct of file list of witnesses—Effect—Such direction under R. 76(b) of Punjab Local government Elections Rules, 2000, is procedural and directory in nature—Non-compliance of such direction, when not shown to have affected the trial, is of no legal significance. PLD 2003 Lah. 35

77. Dismissal of petition during trial. – the tribunal may dismiss an election petition if;-
a) the provisions of rules 71, 72 and 73 have not been complied with: or
b) the allegations contained therein are vague or do not disclose the commission of any corrupt practice, material irregularity, or other illegal act.

78. Power of Tribunal. -The Tribunal shall have all the powers of civil court trying a suit under the Cod of Civil Procedure, 1908 ( Act V of 1908 ), and shall be deemed to be civil court within the of sections 480 and 482 of the Code of Criminal Procedure, 1898 (Act V of 1898).

79. Recrimination where seat is claimed. –

1. where is an election petition a declaration is claimed that a candidate other that the retuned candidate has been duel elected, the retuned candidate or any other party may produce evidence to prove that the election for such other candidate would have been declared void had he been the retuned candidate and had a petition been presented calling his election in question;
Provided that the retuned candidate or such other party as aforesaid shall not be entitled to give such evidence unless he or it has within fourteen days net following the commencement of the trial, given notice to the Tribunal for his intention so to do and has also deposited the security referred to in rule 71.

2. Every notice referred to in sub=rule (1) shall be accompanied by statement of the case, and all the provisions relating to the contents, verification, trial, procedure of an election or to the security deposit n respect of an election petition shall apply to such a statement as if it were in election petition.

80. Decision of the Tribunal. -The Tribunal may upon the conclusion of the trial of an election petition make an order: –

a. dismissing the petition;

b. declaring the election of the returned candidate to be void;

c. declaring the election of the retuned candidate to be void and the petitioner or any other contesting candidate to have been duly elected.

d. Declaring the election as a whole to be void.

81. Grounds of declaring election of returned candidate void. –

1 The Tribunal shall be declare the election of the returned candidate to be void if it is satisfied that-

a) the nomination of the returned candidate was invalid; or
b) the retuned candidate was not, on the nomination day qualified for, or was disqualified from, being elected as a member or Nazim or Naib Nazim, as the case may be; or
c) the election of the returned candidate has been procured or induced by any corrupt or illegal practice; or
d) a corrupt or illegal practice has been committed by the retuned candidate of his election agent or by any 9ther person with the connivance of the candidate r his authorized agent.

2 The election of a returned candidate shall not be declared void on the ground-

a. that may corrupt of illegal practice has been committed, if the Tribunal is satisfied that it was not committed by or with the consent or connivance of that candidate or his election agent and that the candidate and the election agent took all reasonable precaution to prevent its commission; or
b. that any of the other contesting candidates was, on the nomination day, not qualified for or was disqualified from, being elected as a member.

82. Ground for declaring a person other than a returned candidate elected. -The Tribunal shall declare the election of the returned candidate to be void and the petitioner or any other contesting candidate too have been duly elected, if it is so claimed by the petitioner or such other contesting candidate was entitled to be declared elected.

83. Ground for declaring election as a whole void. – The Tribunal shall declare the lection as a whole to be void if it is satisfied that the result of the election has been materially affected by reason of-
A the failure of any person to comply with the provisions off the Ordinance or the Election Rules; or
B the prevalence of extensive corrupt or illegal practice at he election.

84. Decision in case of equality of votes. –

1. Where, after the conclusion of the trial, it appears that there is an equality of votes between two or more contesting candidates and the addition of one vote for one such candidate would entitle him to be declared elected, the Tribunal shall draw a lot in respect or such candidates and the candidate on whom the lot falls shall be deemed to have received the highest number or votes entitling him to be declared elected.

2. Before proceeding to draw a lot under sub-rule (1), the Tribunal shall give notice to the contesting candidates between whom there is an equality of votes and shall proceed to draw a lot on the day and the time and place stated in the notice;

Provided that, if the contesting candidates are present when it appears that there is an equality of votes between them, the Tribunal may proceed forthwith to draw a lot without giving notice as aforesaid.

85. Other Provisions relating to Tribunal. -An order to the Tribunal under rule 81 shall take effect on the date on which it is made and shall be communicated to the Chief Election Commissioner and the Government.

86. Abatement on death of petitioner. – An election petition shall abate on the death of a sole petitioner or of the sole survivor of several petitioners.

87. Death or withdrawal. -If, before the trial of an election petition, a respondent dies or gives notice in writing that he does not intend to contest the petition, and no respondent remains to contest the petition, the Tribunal shall without any further hearing or after giving such person as it may think fit an opportunity of being heard, decide the case ex-prate.

88. Failure of petitioner to appear. – Where, at any stage of the trial or an election petition, no petitioner makes an appearance the Tribunal may dismiss the petition for default and make such order as to costs as it may think fit.

89. Order as to costs. –

1. The Tribunal shall, when making an order under rule 81 also make an order determining in its discretion the costs and specifying the persons by and to whom such costs are to be paid.

2. If, in any order as to costs under sub-rule (1) there is a direction for the payment of costs by any part to tiny person, such costs shall , if they have not already been paid, be payable in full and shall, upo9n application in writing in that behalf made to the Tribunal within sixty days of the order by the person to whom costs have been awarded, be paid as four as possible, out of the security for costs deposited by such party.

3. Any order for costs may be enforce upon an application in which the ward to which the disputed election relates is situated, s if such order were a decree passed by that Court;
Provided that no proceeding shall be brought under this sub-rule except in respect or costs, which have been recovered by an application under sub-rule (2).

90. Withdrawal of petition. –

1. An election petition may be withdrawn by leave of the Tribunal.

2. Where the Tribunal grants leave, the petitioner shall be ordered to pay the costs incurred by respondents to the election petition or such portion thereof as the Tribunal may direct.

91. Supply of copies of decision on petition. –

1. The Tribunal on application in writing may furnish copies of any interim or final orders passed by the Tribunal on any election petition to the parties to the petition.

2. The fee for supply for copies under sub-rule (1), shall be ten rupees for each page.

3. Every application for the supply of copies under sub-rule (1) shall be accompanied by court fee stamps of the requisite value.

92. Retention of the record. – The Tribunal shall, after an election petition has been disposed of, forward the record thereof to the Provincial Election commissioner who shall retain such record for a period of five years from the date of its receipt and shall there after cause it to be destroyed.

CHAPTER XI

ELECTION REPORTS

93. Reports by Returning Officer. – Within a month of the holding of the election , the Returning Officer shall submit to the Provincial Election Commissioner a detailed report about the conduct of the election specifically stating:

a. all the arrangements made for the election;

b. total number of the voters and the actual number or votes cast;

c. any incident of which affected or could have affected smooth polling;

d. such other information as may be required by the Provincial Election Commissioner.

94. Report by the Provincial Election Commissioner. The Provincial Election Commissioner shall draw up a report on the elections held in his Province and such report may be published.
