ORDINANCE XLIX OF 1999

No. Legis. 3(XLIX)/99, dated 28-9-1999, -The following Ordinance promulgated by the Governor of the Punjab is hereby published for general information:
Preamble. –Whereas, it is expedient further to amend the Punjab Local Government Ordinance, 1979 (VI of 1979) in the manner herein-After appearing;
And whereas, the Provincial Assembly of the Punjab is not in session and the Governor of the Punjab is satisfied that circumstances exist which render it necessary to take immediate action;
Now, therefore, in exercise of the powers conferred upon him under Article 128 of the Constitution of the Islamic Republic of Pakistan the Governor of the Punjab is pleased to make and promulgate the following Ordinance:
1. Short title and commencement. —
(i) This Ordinance may be called the Punjab Local Government (Amendment for Abolishing of Certain Taxes) Ordinance 1999
(ii) It shall come into force at once and shall be deemed to have taken effect on the day the Punjab Local Government (Amendment for Abolishing of Certain Taxes) Ordinance, 1999 (XXIX of 1999) stands repealed under Article128 (2) of the constitution.
2. Amendment of section 3 of ordinance VI of 1979. —In the Punjab Local Government Ordinance, 1979 (VI of 1979) hereinafter referred to as the said Ordinance in section 3, in subsection (1), in clause (Ix) the words “but for purpose of tax on the export of goods and animals the Zila including its urban areas” shall be omitted.
3. Amendment of second schedule of Ordinance VI of 1979. –In the said Ordinance in the Second Schedule—
(i) in Part I entry No.12 shall be omitted.
(ii) In Part II entries Nos. 1 and 7 shall be omitted; and
(iii) In Part III entries Nos. 1 and 5 shall be omitted.
4. Ordinance to override contracts. –This Ordinance shall have effect notwithstanding anything contained in any contract or any other instrument creating any liability or obligation against the Government or a Local Council in relation to taxes abolished by this Ordinance.
