8.11 read with Civil Procedure Code, 1908, Section 115–Agricultural land–Grant of–Cancellation of grant without notice–Challenge to–Whether jurisdiction of Civil Court was barred–Question of–Held: Applicant was condemned unheard in violation of principles of natural justice and as such, order challenged being a malafide order, bar contained in Section 11 of Sindh Revenue Jurisdiction Act, 1876, is not applicable–Petition accepted and suit remanded for disposal on merits. Civil Procedure Code (V of 1908, O.VII, R. 11, S. 9–Rejection of plain wherein cancellation of allotment by Revenue Officer was challenged Plaintiff had instituted suit without exhausting remedies available to hi by way of appeal/revision etc. under relevant law–Court while rejecting plaint was although required to look to plaint it self yet where othe remedies were available to plaintiff in the form of appeal/revision and he had not availed those remedies nor had mentioned in his plaint that he ad filed appeal against cancellation of grant of land which was essential requirement in terms of S. 11, Sindh Revenue Jurisdiction Act, 1876, sth filed by him was incompetent and had been rightly rejected by Court PLJ 1998 Karachi 685
