Client Query 016:- Hello, hope everything is well at your end. We wanted to clarify one thing that once having gone through the process of pre-qualification as per the PPRA rule 15 and 16 and have pre-qualified firms for different minor civil, elect and plumbing works for a certain period of time say 1 year then, can a department float tenders among only pre-qualified contractors/firms through invitation letter or does it have to float tender through PPRA and department website and through news dailies as required in open bidding procedure? Answer:- Thank you very much for writing to us. Based on your query the prequalification of suppliers and contractors is carried out under Rules 15-18 of Public Procurement Rules, 2004. Procuring agency is required to specify in the bidding documents whether the prequalification is carried out for a specific job for once time or a period for completion of similar jobs. However, such period should not be more than one or two years to provide level playing field to all competitors. Prequalification can be carried out only for services, civil works, turnkey projects and in case of procurement of expensive and technically complex equipment to ensure that only technically and financially capable firms having adequate managerial capability are invited to submit bids under Rule 15 of Public Procurement Rules, 2004. In case a prequalification process is undertaken in accordance with rules 15 & 16 of Public Procurement Rules, 2004, then further bidding process among the prequalified bidders is termed as “limited competitive bidding”. It is not obligatory to upload tender on PPRA’s website and / or publish in newspapers while asking the prequalified bidders to submit bids/offers etc.
