Client Query 164:-Hi, wanted to ask that if the selected supplier fails to provide samples and does not or is hesitant to abide by the terms and conditions, we should cancel his contract and consider next bidder keeping in view the very short time left in project completion timelines, which have already delayed considerably? Your early response in this regard would be highly appreciated!

Answer:- Thank you very much for writing to us. As per your query, a procuring agency shall follow standard terms and conditions provided in the bidding documents. If a lowest evaluated bidder fails to provide the relevant goods / samples as per agreed TORs then his bid security can be forfeited. The procuring agency is required to award the contract to 2nd lowest evaluated bidder keeping in view the principles of procurement outlined in Rule 4 of Public Procurement Rules, 2004.
