Answer:- Thank you very much for writing to us. As per your query, a procuring agency shall follow standard terms and conditions provided in the bidding documents. If a lowest evaluated bidder fails to provide the relevant goods / samples as per agreed TORs then his bid security can be forfeited. The procuring agency is required to award the contract to 2nd lowest evaluated bidder keeping in view the principles of procurement outlined in Rule 4 of Public Procurement Rules, 2004.
