Wanted to as that, can we contract with the second-in-line vendor/the second lowest bidder of the bidding process and collect excess costs from the defaulting vendor if vendor fails to deliver the required item even after the expiry of delivery Period or the time period allowed to vendor to replace/repair the defected item and initiate appropriate action against vendor as per the terms and conditions of Purchase Order? As per your query the Bid security of the first lowest bidder can be forfeited and other action(s) such as blacklisting etc. can also be taken against such bidder in the light of provisions already mentioned in the bidding documents and the contract may be awarded to the second lowest bidder.
