It is like a never ending lesson which the actors in the Unicorn infested PPE market never learn.
There should be a ‘Hall of Shame’ for the Doctors turned brokers, realtors turned PPE consultants, and intermediaries who label themselves as Buyers and Sellers of impossible quantities of PPE and the lawyers who assisted them in lying through their teeth all of this year.
The large, impossible 500m glove boxes do not exist.Period.No matter what anyone tells me, I will state it once again.Please take a cold shower and ask yourself, why would 500m boxes of gloves be sitting in a Bonded Warehouse, anywhere in the world, especially at a time when COVID19 emergencies require so much PPE to be pumped into the supply chain on a monthly basis.
Period.
A few days ago, some very dear and close friends of my law firm lost a lot of credibility, time , happiness and money, trying to wait for an impossible SGS report promised by a lawyer for an impossible quantity of PPE.I was not surprised that the entire cheerful and hopeful countenance of my friends (who were intermediaries in this case) and the way their plans to have a decent christmas were effectively destroyed by these Unicorns.
What really annoyed me was that the terms of the SPA read as follows “The (so-called) Sellers lawyer….shall ensure ownership of the Product is passed to the Buyer, once payment is in fact received and due to the Seller in Accordance with the Agreement terms and agreed Incoterm…..For avoidance of doubt, (The Sellers Attorney) as the Payment Master is not a principal in this Agreement; but fulfils the role of sourcing agent and payment master and will be held liable to execute its duties in strict accordance with this Agreement.”
Then again, where had this lawyer lady seen the 500 million glove boxes with her own eyes.It was obviously a brokers attorney very much hopeful of getting a chunk of the nice commission for herself.
Greed makes us stupid, and makes us lose sight of our professional duties.This so called lawyer is now claiming she is speaking to the Title Owner of the goods, which makes her claim that her Joker broker was the seller in the SPA a proper fraudulent Act.
My friends who are also a bunch of honest intermediaries, are puzzled.
I am unsure whether my friends will be taking this up legally, but it is a moment of shame for the Legal Profession.
I am furious and I mean it, as this is not first dishonest lawyer I have seen endorsing every piece of Unicorn Fiction a middleman tells them, under the promise of a big pay day.
