AN ORDINANCE
Further to amend the Oil and Gas Regulatory Authority Ordinance, 2002

No. 2(1)/2009-Pub.—The following Ordinance promulgated by the President is hereby published for general information:¬—

WHEREAS it is expedient further to amend the Oil and Gas Regulatory Authority Ordinance, 2002 (XVII of 2002), for the purposes hereinafter appearing;

AND, WHEREAS the National Assembly is not in session and the President is satisfied that circumstances exist which render it necessary to take immediate action;

NOW, THEREFORE, in exercise of the powers conferred by clause (1) of Article 89 of the Constitution of the Islamic Republic of Pakistan, the President is pleased to make and promulgate the following Ordinance:—

1. Short title and commencement.—(1) This Ordinance may be called the Oil and Gas Regulatory Authority (Amendment) Ordinance, 2009.
(2) It shall come into force at once.

2. Amendment of section 2, Ordinance XVII of 2002.— In the Oil and Gas Regulatory Authority Ordinance, 2002 (XVII of 2002), hereinafter referred to as the said Ordinance, in section 2, in sub-section (1), in clause (xxxvii), for the words “but does not include” the words “and includes” shall be substituted.

3. Amendment of section 6, Ordinance XVII of 2002.—In the said Ordinance, in section 6, in sub-section (2), in clause (s), after the word “gas” occurring twice, the word and letters “and CNG” shall be inserted.

4. Amendment of section 21, Ordinance XVII of 2002.—In the said Ordinance, in section 21, in sub-section (2), in clause (h), after the word “petroleum”, the word and letters “and CNG” shall be added.

5. Insertion of section 43B, Ordinance XVII of 2002.—In the said Ordinance, after section 43A, the following new section shall be inserted, namely:—

“43B, Sale price of CNG.—Notwithstanding anything contained to the contrary in this Ordinance or any other law for the time being in force, the Authority, in accordance with the policy guidelines issued by the Federal Government from time to time, shall determine and notify the maximum sale price of CNG to be charged by a licensee from a consumer for vehicular or other mobile use.”
