Every suit by a minor must be instituted in his name by a person called “next friend” of the minor, and a suit instituted directly by the minor may be struck off the file.Where the defendant is a minor, the court on being satisfied of the fact of his minority must appoint a proper person to be guardian ad litem for the suit for such minor.
