Before Ellis and Ispahani, JJ.
CROWN – Complainant
Moulvi ABDUL RASHID TARKABAGISH, M. L. A., OF SERAJGANJ – Accused
Criminal Miscellaneous No. 56 of 1949, decided on 28th November, 1949.
Contempt of Court – Qualified expression of regret or apology tendered through the mouth of counsel should not be accepted.
Qualified expression of regret or the apology tendered through the mouth of counsel is not a sufficient expiation of the offence of contempt of Court. To accept it, would inevitably create the impression that contempts of this kind, however much they may be condemned in theory, can in practice be purged by an expression of regret. Such an impression would be indeed disastrous and would do nothing to deter others from interfering with the course of justice. [p. 4.]
A. K. Fazlul Haq, M. Fazlul Haq and Ali Amjad Khan, for Accused.
