Plea of double jeopardy-Trial of accused under Control of Narcotic substances Act, 1997 after their trial under the Customs Act, 1969-Validity-point in issue was as to whether a person who had been tried by the Special judge, Customs and either acquitted or convicted for smuggling or being in possession of narcotics could be tried for the second time by the special judge under the Control of Narcotics being one and the same, the Constitution, S. 26 of the General Clauses Act, 1897 and S. 403 of Criminal Procedure code, 1898-Case pending against the accused were quashed accordingly
