THE WAPDA (CHAIRMAN AND MEMBERS) SERVICE RULES, 1972

Notification No. S.R.O. 966 (I)/72.— In exercise of the powers conferred by section 5 of the West Pakistan Water and Power Development Authority Act, 1958 (West Pakistan Act No. XXXI of 1958), read with paragraph (a) of clause (I) of Article 12 of the Province of West Pakistan (Dissolution) Order, 1970 (P.O. No. I of 1970), the President is pleased to make the following Rules, namely:–

 

1.         Short title and commencement.—(1) These Rules may be called the West Pakistan Water and Power Development Authority (Chairman and Members) Service Rules, 1972;

(2)        They shall come into force at once

2.         Definitions.— Unless the context otherwise requires, the words and expressions used in these Rules and defined in the West Pakistan Water and Power Development Authority At, 1958 (West Pakistan Act XXXI of 1958), of the Fundamental Rules or the Supplementary Rules or the Civil Service Regulations or the General Financial Rules for the time being in force shall have he same meanings as are respectively assigned to them in the said Act. Rules or Regulation, as the case may be.

 

3.         Remuneration.— The following pay and allowances shall be admissible to the Chairman, namely:–

(A)        CHAIRMAN

(1)        Pay— (i)            If a serving Government servant is appointed as Chairman pay admissible                to a Secretary to the Federal Government in the scale of pay to which the                                   Government servant is entitled.

(ii)         If a non-official is appointed as Chairman such pay as may be determined by the President.

(iii)        If a retired Government Servant is appointed as Chairman pay admissible to a Secretary to the Federal Government in the prescribed scale of pay, pension being held in abeyance.

(2)        Sumptuary allowance.—The sumptuary allowance shall be regulated in accordance with the orders issued by the Federal Government from time to time.

(3)        House and House Rent.— Residential accommodation will be provided o the scale laid down by the Punjab Government for Officers of the same status or pay and under the same conditions and the rent shall be charged on the basis laid down by the Federal Government for its employees.

(4)        Car allowance.—No car allowance will be admissible and no car will be made available for the private use of the Chairman. But if the Federal Government is of the opinion that the officer has to tour extensively at his headquarters and no staff car is made available to him for this purpose it may sanction such car allowance not exceeding Rs.250 per month as it may deem fit in order to compensate him for the local journeys performed by him on official business in his private car.

(B)        Members:–

(1)        Pay–    (i)         If a serving Government servant is appointed as Member:

Pay admissible to a Joint Secretary to the Federal Government in the scale of pay to which the Government servants entitled.

(ii)         If a non-official is appointed as Member: Such payment may be determined by the President.

(iii)        If a retired Government servant is appointed as Member pay admissible to a Joint Secretary to the Federal Government in the prescribed scale of pay, pension being held in abeyance.

(2)        House and House Rent.—Residential accommodation will be provided on the scale laid down by the Government for officers of the same status or pay and under the same conditions and the rent shall be charged on the basis laid down by the Federal Government for its employees.

(3)        Car allowance.—No car allowance will be admissible, and no car will be made available for the private use of the Members. But if the Federal Government is of the opinion that the officer has to tour extensively at his headquarters and no staff car is made available to him for this purpose it may sanction such car allowance, not exceeding Rs.150 per month as it may deem fit in order to compensate him for the local journeys performed by him on official business in his private car.

4.         Leave.— (1) Chairman and Members shall be governed by the Prescribed Leave Rules, 1955:

Provided that a Chairman or a Member who, on the date of his appointment as such was being governed by Leave Rules other than the above-mentioned Rules shall continue to be so governed and his service as Chairman or Member shall count for such leave.

(2)        For the purpose of casual leave, the Chairman and the Members shall be governed by the Rules, applicable to the Federal Government employees in the case of Chairman the leave shall be sanctioned by the Federal Government and in the case of member by the Chairman.

 

5.         Traveling allowance.— The Chairman and the Members shall be governed by the Rules applicable to the Federal Government employees. The Chairman shall be entitled to traveling allowance as admissible to a Secretary to the Federal Government and a Member shall be entitled to traveling allowance as admissible to Joint Secretary to the Federal Government.

 

6.         Provident fund.— (1) A Chairman and a Member, who on the date of his appointment as such was in the service of the federation or a Province and prior to that date was admitted to the benefit of any Provident Fund maintained by the Government shall be eligible after appointment as Chairman or Member to continue to subscribe to the said Fund upon the same terms and conditions and subject to the Rules of that Fund:

            Provided that a Chairman or a Member as the case may be shall cease to subscribe to the Fund on attaining the age of superannuation and the amount standing to his credit in the said Fund, after such deductions as are admissible under the Rules applicable to him, shall become payable to him.

(2)        A Chairman or a Member, who on the date of his appointment as such as was not in the service of the federation or a Province, shall not be eligible to joint the General Provident Fund.

7.         Medical attendance.— The Chairman and the Members shall be governed by the Medical Attendance Rules applicable to the Federal Government employees:

            Provided that a Chairman or a Member who prior to the date of his appointment as such was governed by any other Rules shall continue to be governed by the said Rules.

8.         Supplementary.— (1) In all matters not provided for in these Rules, the Chairman and the Members shall be governed by the Rules applicable to the officer of their status under the Federal Government.

(2)        Where the existing terms and conditions of appointment of a Chairman or Member already holding charge as such are more favourable than those provided in these rules, the former will continue to apply to him for as long as he holds that post.

9.         Repeal.—The West Pakistan Water and Power Development Authority (Members) Service Rules, 1960, as notified under the former Government of West Pakistan Irrigation, Communications and Works Department Notification No.2/18-Irr.Div./58,SOI, dated the 19th August, 1960, are hereby repealed.
