Can A Pakistani, adult, Muslim man contract another Marriage? What is the Procedure involved?

A man can enter into another marriage provided he acquires permission in writing of the Arbitration Council, under Muslim Family Law Ordinance, without such permission marriage will not be registered.

The procedure involved in contracting another marriage in Pakistan includes the following steps:

  1. Consent and intention: The man should have the intention and desire to enter into another marriage. It is important to ensure that all parties involved, including the existing wife or wives, are aware of and agree to the subsequent marriage. The man should seek the consent of his existing wife or wives before proceeding.
  2. Legal requirements: The man must fulfill the legal requirements for marriage in Pakistan. This typically includes obtaining the necessary documents, such as a valid identification document (e.g., CNIC or passport) and other relevant certificates (e.g., birth certificate). The exact documents required may vary depending on the jurisdiction and personal circumstances.
  3. Nikah ceremony: The man needs to perform a Nikah ceremony, which is the Islamic marriage contract, with the intended spouse. The Nikah ceremony is typically conducted by an authorized Islamic cleric or religious authority who oversees the process and ensures compliance with Islamic rituals and requirements.
  4. Documentation: After the Nikah ceremony, the marriage should be documented. The Nikahnama, the marriage certificate, is filled out by the couple and the witnesses present during the ceremony. The Nikahnama serves as proof of the marriage and should be properly registered with the relevant authorities, such as the local union council or marriage registrar, to ensure legal recognition.

It is important to consult with an authorized Islamic cleric or religious authority to obtain guidance specific to the region and to ensure compliance with the religious requirements and rituals of a Muslim marriage. Additionally, it is advisable to consult with legal professionals to understand any legal obligations or requirements associated with subsequent marriages and to ensure compliance with applicable laws and regulations in Pakistan.
